- hereinafter  referred to as “Organizer”. 

1. SUBJECT
These conditions of participation apply to all competitions organized by CUORE on the Instagram page www.instagram.com/cuoreofswiss or the Facebook page www.facebook.com/cuoreofswiss.

The competitions are in no way connected to Instagram or Facebook and are in no way sponsored, supported or organized by Instagram or Facebook. The recipient of the data provided by the participants is not Instagram or Facebook, but CUORE. All information in the context of the competitions is provided exclusively by CUORE as the organizer.

2. PARTICIPATION
By participating in the competition, the Instagram user or Facebook user expressly accepts these general terms and conditions of participation. In the event of a
breach of the conditions of participation, the participant will be excluded from the competition. The minimum age for participation is 18 years. Participation is only possible via personal Instagram or Facebook registration (own Instagram or Facebook account). Employees of CUORE and their relatives are excluded from participation.

The start of the competition is the date of publication on the Instagram page ww.instagram.com/cuoreofswiss or the Facebook page www.facebook.com/cuoreofswiss. Participation is only possible until the time specified in each case. The relevant times can be found in the competition details on the Instagram or Facebook page.

Depending on the competition, participation is possible by liking a post on our Instagram or Facebook page or that of a partner, commenting on it or writing a message to CUORE as the operator of the Instagram or Facebook page. Furthermore, votes are also held among Instagram or Facebook users to determine a winning entry (e.g. “The photo with the most likes wins”). The specific actions required to take part in a competition on the Instagram page www.instagram.com/cuoreofswiss or the Facebook page www.facebook.com/cuoreofswiss can be found in the description of the competition in the competition post on Instagram or Facebook.

Participation after the specified date for the awarding of the prize is excluded. The electronically logged receipt by the organizer is decisive. The organizer cannot be held responsible for any technical malfunctions, e.g. any telephone network outages or server malfunctions that prevent timely participation.

The organizer reserves the right to change the competition components due to unforeseen circumstances without prior notice, to cancel or terminate the competition. The latter applies in particular if software or hardware errors occur and/or the proper execution of the competition is no longer possible for other technical or legal reasons.

3. CONTENT
The organizer is not liable for content uploaded to the participants' Instagram or Facebook pages. In this respect, the participant indemnifies the organizer in full against all third-party claims, including the necessary costs of legal defense and prosecution.

4. PRIZES / DETERMINATION OF WINNERS
The prize will be stated in the respective competition post and can be found on the Instagram page www.instagram.com/cuoreofswiss or the Facebook page www.facebook.com/cuoreofswiss. Only non-cash prizes will be awarded, the payment or exchange of which is excluded. The prize is non-transferable.

Determination/acceptance of winners: The winner will be determined by drawing lots, unless the Instagram or Facebook post states otherwise, e.g. - the photo with the most “likes” wins (voting among users). In the random draw, a CUORE jury consisting of at least two employees will determine the winner from all participants.

If you are not required to post your own content in order to take part, but only have to “like” a post or answer a question, for example, the winner will be chosen at random. The winners will be determined immediately after the end of the competition and notified via Instagram or Facebook.

The winner must confirm acceptance of the prize in writing (by email) within a period specified in the prize notification. As a rule, the prize will be delivered by
post or email, so the winner must provide their full contact details, postal address and email address when being notified. If the prize is not delivered but has to be collected at the venue, this will be indicated separately in the posting. Legal recourse is excluded.

5. LIABILITY
Insofar as the non-cash prize is a third party offer, CUORE is not liable for non-performance or poor performance or for damages suffered by the winner when
using the service. The respective terms and conditions of the prize sponsors apply; any warranty claims or claims for damages must be addressed to them.

As the organizer of the prize draw, CUORE is only liable for damages in connection with the prize draw that were caused intentionally or hrough gross negligence by employees of the company. As the prize provider, the organizer is not liable for damages due to malfunctions of technical equipment, for delays or
interruptions of transmissions or for damages in connection with participation in the prize draw.

6. PRIVACY POLICY
Personal data will be collected from the winner for the purpose of running the competition. In the event of a win, the organizer is entitled to publish the
Instagram profile picture or Facebook profile as well as the name of the winner on Instagram or Facebook and the website www.cuore.ch. By participating in an Instagram competition from CUORE at www.instagram.com/cuoreofswiss or a Facebook competition from CUORE at www.facebook.com/cuoreofswiss,
each participant agrees to this privacy policy.
